Sexually Violent Predator Determination Process
As per N.C.G.S. § 14-208.6(6), a sexually violent predator is a person who has committed a sexually violent crime and has been convicted for the same. Also a person who suffers from personality disorder or mental abnormality, that makes the person highly probable of committing a sexually motivated crime against a complete stranger or person who is known or with a person who has been familiarized for victimization.
- As per N.C.G.S. § 14-208.6(1f), mental abnormality is a condition that can affect the volitional or emotional capacity of an individual that causes the person to commit sexually motivated criminal activities to the extent that the individual becomes a hazard to the safety and health of those living around.
- As per N.C.G.S. § 14-208.6(2a), personality disorder is the enduring reflection of the behavior and inner experience that deviates a person from the expectations set by the culture he or she is brought up in, is inflexible and pervasive, began in the childhood or teenage, is stable at times, and ultimately leads to impairment or distress.
For an individual to be designated as a sexually violent predator, the requirements mentioned in N.C.G.S. § 14-208.20 should be complied with. The requirements of N.C.G.S. § 14-208.20 are as follows:
When an individual is charged by the indictment or with the information found with the commission of a sexually motivated crime, the district attorney will have to determine whether or not to classify the convicted as a sexually violent predator. If the decision to seek the classification of sexually violent predator is yes, then the district attorney will need to file the intent of the attorney on a notice. The filing of the notice should be done within the time frame given for the filing of pretrial motions, as per N.C.G.S. § 15A-952.

Email notification
In North Carolina you can also sign up for an email notification at this link http://signup.ncsbi.gov/ and whenever a sex offender would come to reside within 1 to 5 miles of your address; you will get an email notification. Additionally, you can register more than one NC address, this way you will get notified if any sex offender moves in 1 to 5 miles close to all the location you have registered. Most common locations registered for the email address notification are home address, grandparent’s home, day care center etc.
Sex Offender APP
The Attorney General in NC would like all the citizens in the state to know the whereabouts of all the sex offenders living in the state. In order to achieve this goal, the office has designed an app for iPod touch, iPad and iPhone called the NC Sex Offender Registry app. This app uses GPS to map the residence of the sex offender, making the information mobile. You can use the app to search sex offenders by address and you can also get email notification for specific sex offenders. The information technology department of the Attorney General’s office had developed this app. It uses the information from the data collected by the State Bureau of Investigation.
